Acceptable Use Policy

SKYFY seeks to create and foster an online community that can be used and enjoyed by all its customers. To further that goal, SKYFY has developed an Acceptable Use Policy. Although much of what is included here is common sense, SKYFY takes these issues very seriously and will enforce its rules to ensure enjoyment by all its customers. SKYFY therefore reserves the right to remove any content posted to its system, which it deems offensive, inappropriate, or in violation of its policies. It also reserves the right to suspend or cancel a customer’s account and use of SKYFY systems and/or services for engaging in inappropriate conduct or conduct that may overburden or become excessive to SKYFY systems and/or services (Customers, of course, also remain legally responsible for any such acts). In using SKYFY, customers accept these restrictions as well as those set forth in the SKYFY End-User Service Agreement and agree to use the Service only for lawful purposes and not to use, or allow others to use SKYFY:

 

1. To post or transmit hate speech, threats of physical violence, or harassing content;

 

2. To post or transmit material in violation of copyright laws.

 

3. To post or transmit content that is legally obscene or violates child pornography statues or contain graphic visual depictions of sexual acts, visual depictions or sexually explicit conduct involving children, or depiction of children, the primary appeal of which is prurient;

 

4. To post or transmit other sexually oriented material that, in the specific context, is offensive or inappropriate;

 

5. To post or transmit commercial bulk e-mail from a residential/personal account without prior written approval of SKYFY

 

6. To post off-topic or commercial messages on bulletin boards;

 

7. To engage in illegal, unlawful, or tortuous conduct or other conduct that interferes with SKYFY ability to provide Service
or interferes with the rights of others including, but not limited to libel, invasions of privacy, consumer fraud, unauthorized
dissemination of trade secrets, violation of trademark laws, hacking, or transmittal of commercially restricted information.

 

8. To run packet sniffers, decoders, analyzers, password gatherers, or other similar tools for any purpose whatsoever.

 

Subscribers/Customers will not resell SKYFY Service, or any portion thereof, or otherwise charge others to use SKYFY, or any portion thereof. Further, Customer will not redistribute the SKYFY Service, or any portion thereof, whether or not Customer receives compensation for such redistribution.

 

You may not reproduce, duplicate, copy, sell, provision, resell, rent, lease, lend, pledge, directly or indirectly transfer, distribute or exploit any portion of the Service without prior written consent from SKYFY. You will not use the Service in a manner prohibited by any federal, state, or local law or regulation, and will abide by SKYFY Policies, which set forth additional rules that govern your activity in connection with the Service. Without limiting the foregoing, you may not use the Equipment or Service, or allow the Equipment or Service to be used, for any abusive purpose or in any way that damages SKYFY property or interferes with or disrupts SKYFY Network, SKYFY Services or other users or subscribers. You may not attempt to circumvent user authentication or security of any host, network, or account (also known as “cracking” or “hacking”). This includes, but is not limited to, accessing data not intended for you, logging into a server or account that you are not expressly authorized to access, or probing the security of other networks. You may not attempt to interfere with service to any user, host, or network (“denial of service attacks”). This includes, but is not limited to; “flooding” of networks, deliberate attempts to overload a service, and attempts to “crash” a host. You may not use any kind of program/script/command, or send messages of any kind, designed to interfere with a end-user’s session, by any means, locally or via the Internet. You may not use the Service or take any action that will result in excessive consumption or utilization of SKYFY system or network resources, or which may adversely affect network performance, or which adversely affects the performance of the Service for other SKYFY customers, all as determined in SKYFY sole discretion. You agree not to access the Service simultaneously through multiple unauthorized units (such as by duplicating or cloning characteristics of another network device) or to authorize any other individual or entity to use the Service. You agree that sharing the Service with another party breaches the End-User Service Agreement and may constitute fraud or theft, for which SKYFY, its affiliates, and their agents and suppliers reserve all rights and remedies.

 

You agree not to use or attempt to use the Service, the SKYFY Network or website, or Equipment or any device for any fraudulent, unlawful, harassing or abusive purpose, or so as to damage or cause risk to SKYFY business, reputation, employees, subscribers, facilities, or to any person. Improper uses include, but are not limited to: (i) Violating any applicable law or regulation; (ii) Posting or transmitting content you do not have the right to post or transmit; (iii) Posting or transmitting content that infringes a third party's trademark, patent, trade secret, copyright, publicity, privacy, or other right; (iv) Posting or transmitting content that is unlawful, untrue, stalking, harassing, libelous, defamatory, abusive, tortuous, threatening, obscene, hateful, abusive, harmful or otherwise objectionable as determined in our sole discretion; (v) Attempting to intercept, collect or store data about third parties without their knowledge or consent; (vi) Deleting, tampering with or revising any material posted by any other person or entity; (vii) Accessing, tampering with or using nonpublic areas of the Service or any SKYFY website or SKYFY computer systems or network; (viii) Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures; (ix) Attempting to access or search the Service or any SKYFY network or website with any engine, software, tool, agent, device or mechanism other than the software and/or search agents provided by us or other generally available third party web browser; (x) Sending or attempting to send unsolicited messages, including without limitation, promotions or advertisements for products or services, "pyramid schemes", "spam", "chain mail", "junk mail" or junk fax”; (xi) Using or attempting to use the Service or any SKYFY website to send altered, deceptive or false source-identifying information; (xii) Attempting to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the Service or any SKYFY website; (xiii) Interfering or attempting to interfere with the access of any user, host or network, including without limitation, sending a "virus" to the Service or any SKYFY website, overloading, "flooding," "spamming," "crashing," or "mailbombing" the Service or any SKYFY website; and/or (xiv) Impersonating or misrepresenting your affiliation with any person or entity. Such prohibited actions include, but are not limited to: using the Service to host a web server site which attracts excessive traffic at your Premises, continuously uploading or downloading streaming video or audio, UseNet hosting, or continuous FTP uploading or downloading. In the event that SKYFY detects excessive use by you, SKYFY may restrict your access to SKYFY Network, increase the fees associated with
your Service, including upgrading you to a higher class of Service, or terminate your Service. SKYFY has the right but not the obligation to restrict any use of the Equipment or Service that SKYFY believes in its sole discretion violates this Acceptable Use Policy, the End-User Service Agreement or applicable law.
